Former Kapkures MCA Paul Kimutai and Accomplice Found Guilty of Sh30 Million Land Fraud in Nakuru

In a landmark ruling, former Kapkures Member of County Assembly (MCA) Paul Kimutai and his associate Richard Kipngeno have been convicted of fraud and forgery involving a Sh30 million plot of land in Mbarut, Nakuru County.

 

Senior Resident Magistrate Priscah Nyotah delivered the verdict on Thursday, finding the duo guilty on four counts related to the illegal acquisition of the 6.6-hectare property. The court established that Kimutai and Kipngeno forged a family agreement on October 12, 2010, which fraudulently transferred the land into their names.

The magistrate further ruled that the two forged a land title deed on November 14, 2012, with the intent to defraud Josiah Njoroge, the rightful owner of the property. “The title deed, coupled with the illegal transmission process, can properly be described as a false document since it purports to confirm the accused persons as genuine owners, yet they are not,” stated Nyotah.

 

Additionally, the court found that the accused forged a green card for the land, falsely claiming it had been opened on June 7, 1990. Evidence presented showed that Land Registrar Daniel Nyantika had not made any entries on the green card, further exposing the fraudulent scheme.

 

Magistrate Nyotah emphasized that the prosecution’s evidence was “consistent, logical, and believable,” while the defense’s case was “disjointed, illogical, and inconsistent.” The defense attempted to shift blame to other individuals but failed to provide credible evidence of how the accused acquired the land from their late father, Chepchilat Rotich, without a grant of letters of administration.

The ruling marks a significant victory in the fight against land fraud in Nakuru County, a region that has seen numerous cases of illegal land dealings. The court’s decision underscores the importance of due process and transparency in land transactions.

 

Sentencing for Kimutai and Kipngeno is set for a later date, as the court prepares to deliver its final judgment on the matter.
