Former Nakuru MCA Put on Defence in Sh. 30M Land Deception Case

Paul Kimutai, a former Kapkures MCA, is facing charges in a 30 million shillings land deception case. Kimutai, along with his friend Richard Kipngeno, has been called to defend themselves in court by Nakuru Senior Resident Magistrate Priscah Nyotah.
This decision comes after the case has been under trial for the past six years.
The two accused were arrested on July 12th, 2017, and later charged with various counts related to land document forgery.
Magistrate Nyotah ruled that the evidence presented by the prosecution linked the two to the offense, necessitating their response to the raised issues.
Kimutai is accused of forging his deceased father’s signature and unlawfully transferring the land to himself and his friend.
He is also charged with forging an agreement dated October 12th, 2010, and falsely claiming it was signed by Kimutai’s family members.
The prosecution has presented compelling evidence against the accused, indicating that they have a case to answer.
The disputed property is a 6.6-acre piece of land located in Miti Mingi, Mbarut, Nakuru County, originally owned by Mr. Josiah Njoroge, who purchased it for 2.85 million shillings.
Furthermore, according to an OB report (42/11/4/2017) obtained from Nakuru Police Station on April 11th, 2017, Kimutai is accused of providing false information, claiming he was the rightful owner of the land.
The defense hearing is scheduled for January 29th and February 6th next year.
